Terms of use.
Draft for review — last updated September 2026.
Installing Emi or signing in means you accept these terms. Please also read the privacy policy, which explains what happens to your data, and the wellbeing & safety page, which is part of these terms.
The short version
- You need to be 16 or older.
- Emi is for everyday wellbeing. She is not a doctor, a therapist, or an emergency service.
- What you write stays yours. We do not use it to train any AI.
- Paid plans renew each period until you cancel. Changed your mind within 14 days and barely used it? Email us and we will refund you.
- Delete your account and we keep it recoverable for 30 days, then erase it. Deleting ends a paid plan straight away and does not refund the time left — cancel the plan instead if you want to use it.
- We will email you 30 days before we change anything that matters to you.
That list is a summary, to help you find things. The sections below are the actual terms.
Who we are
Emi is made by beingAI Corporation, of 750 Alma Lane, Ste 100 #4670, Foster City, CA 94404, USA. In these terms, that company is “we” and “us”. You can reach us at info@beingai.com.
Who can use Emi
You need to be at least 16 years old to have an account. By signing in you are confirming that you are, and that the details you give us are your own.
Emi is not medical or emergency care
Emi offers everyday wellbeing support. She is not therapy, not medical care, and not an emergency service, and she is not a replacement for professional help. Nothing she says is medical advice. If you are in crisis or thinking about harming yourself, please talk to a trained person — the wellbeing & safety page lists where to find one.
Your account
We sign you in with a one-time link sent to your email — there is no password. That means anyone who can read your email can get into your account, so keeping your email secure matters. Tell us at info@beingai.com if you think someone else has access. One account is meant for one person; please do not share it.
Plans, allowances and payment
- Free and paid plans. Every plan gives you a number of guided sessions each month, and paid plans add conversation credits. These reset at the start of each billing period, and unused ones do not carry over.
- Renewing. A paid plan renews by itself at the end of each period, at the price you signed up at, until you cancel.
- Cancelling. You can cancel any time from your account page. You keep what you have already paid for until the end of that period — we do not cut it short.
- Price changes. If we change the price of your plan, we will email you at least 30 days beforehand, and you can cancel before it takes effect.
- Paying. Payments are handled by a payment company — we never see or store your card number. Whether the price includes tax is shown at checkout.
Refunds
If you change your mind within 14 days of paying, and have not used much of that period's allowance, email info@beingai.com and we will refund you. If something we broke stopped you using what you paid for, tell us and we will either fix it or refund you — your choice.
Each meditation costs us real money to make the moment you ask for it, so sessions you have already used are not refundable, and deleting a meditation does not give you the session back. Deleting your whole account ends a paid plan straight away, and the time left on it is not refunded either — see Leaving below. We reply to refund and billing emails within 2 working days. None of this affects the refund rights the law where you live already gives you.
Using Emi fairly
Please do not:
- Use Emi for anything illegal, or to harm or harass anyone.
- Work around your plan's limits, share an account, run Emi through automated tools, or resell access.
- Try to break or overload the service, or extract the AI models behind it.
- Pass off what Emi says to you as professional advice — medical, legal, financial or otherwise — to someone else.
One thing you are very welcome to do: tell Emi how you are actually feeling, including about your health and your state of mind. That is what she is for, and nothing in these terms should be read as discouraging it.
What you write, and what Emi makes
What you write stays yours — your anchoring log, your meditation prompts, your side of a conversation. You are letting us store and use it only as far as running Emi needs: making a session, remembering a conversation, showing you your library. You keep every other right to your own words, including the right to use them anywhere else. We do not use what you write to train any AI.
beingAI Corporation's general terms contain a clause giving the company exclusive rights over anything you post to its services. That clause does not apply to Emi — the paragraph above is what applies instead. The privacy policy explains exactly what we do with your words.
The meditations Emi makes for you — the words and the audio — are yours to keep and use personally for as long as you like, including after you cancel. Please do not resell or republish them. They are made by AI, not checked by a person before you hear them, and so they can sometimes be wrong, repetitive or just not right for you.
Emi will keep changing
We are actively building Emi. Features will be added, changed, and sometimes removed, and we may set sensible limits to keep things working for everyone. If we remove something you paid for, you can cancel and we will refund the part of your period you have not used. We cannot promise Emi will never be down or never go wrong.
Leaving
You can stop using Emi whenever you like, and cancel or delete your account from your account page. Email us if you would rather a person did it.
Deleting is not instant, and that is deliberate. We mark your account for deletion, end any paid plan straight away, and keep the account recoverable for 30 days in case you change your mind. After those 30 days it is erased for good. The time left on a paid plan is not refunded. If you want to use it, cancel your plan instead — it runs to the end of the period you paid for — and delete your account after that. If you come back within the 30 days, your account and everything in it come back, but the plan does not: you would subscribe again.
We may suspend or close an account that breaks these terms, that the law requires us to close, or that is being used in a way that puts the service or another person at risk.
beingAI Corporation's general terms allow an account to be closed straight away, for any reason, with no notice. That is not how we treat an Emi account. Unless the law stops us, we will tell you why, and we will refund the part of a paid period you have not used — unless the account was closed for serious misuse.
When things go wrong
Some responsibilities cannot be signed away, and beingAI Corporation's general terms do not say so. For Emi we do: nothing in these terms or the General Terms limits our responsibility if someone dies or is injured because we were careless, for fraud, or for anything else the law does not let us limit. Whatever these terms say, the consumer protections of the country you live in still apply to you.
Beyond that: Emi is provided as it is; we are not responsible for knock-on losses such as lost profits or lost data; and if we do owe you something, the most we would owe over any twelve months is what you paid us during those twelve months.
Which country's law applies
These terms follow the law of the State of California, USA — the same law the General Terms use — and disputes are handled by the courts in San Mateo County, California. If you are using Emi as a consumer, this does not remove the protections your own country's law gives you, and it does not stop you bringing a claim where you live.
Changes to these terms
beingAI Corporation's general terms allow terms to be changed at any time without warning. For Emi we do not do that. If we change something that matters to you, we will email the address your account uses at least 30 days before it takes effect, and you can cancel before then. Carrying on using Emi after that means you accept the new version. The date at the top is always the version you are reading.
Other terms that apply
Emi is one of several things beingAI Corporation makes, and the company has general terms covering all of them at https://beingai.com/terms-and-conditions/. Those apply to Emi too, and words explained there mean the same here — but where the two differ about Emi, these terms are the ones that apply. The places where they differ are marked above.
Getting in touch
Questions about these terms, refunds, or your account go to info@beingai.com. We answer billing and refund emails within 2 working days, and everything else within 5 working days. Questions about your personal data are answered within 30 days — the privacy policy covers those. Support is by email only and is not an emergency channel; if you need someone now, the wellbeing & safety page lists where to turn.
